WORKING TIME REGULATIONS 48-HOUR RULE OPT-OUT

This voluntary opt-out agreement applies to your employment with Rail Power & Construction Ltd.

Legal Background:

The Working Time Regulations became law on 1st October 1998. It is a law made to implement a Directive made by the European Union and applies to employment law in the UK.
The regulations restrict the number of hours that can be worked by an employee to 48 hours per week, (including all overtime).
The regulations apply to full-time, part-time, agency and casual workers from the day they begin work.
However, the regulations do not cover workers whose time is unmeasured, because they can choose when to work, e.g. management executives within the organization.

Hours of Work:

Employees need not work more than 48 hours per week averaged over a 17-week period (unless they choose to). If as an employee you have worked less than 17 weeks your hours are averaged over the number of weeks worked since you joined the organization.
Working time includes the following; working lunches, business travel time, job-related training and time spent abroad on behalf of a UK based employer.
Working time does not include the following; time spent travelling to and from home to work, rest breaks where the employee is not working, time spent travelling outside normal working time or non-job-related training.
It is not possible to contract-out of the other provisions of the Working Time Regulations, however it is possible to opt-out of the 48-hour rule.

Opting Out of 48-Hour Rule

Under Regulation 4(1) of the Working Time Regulations the organization and you the employee can enter into an individual written agreement to exclude the entitlement to work a maximum 48-hour working week.
As an employee, you do not have to agree to opt-out, it is purely voluntary. You will not be unfairly treated, disciplined or dismissed for refusing to opt-out.
As an employee, you are entitled to bring the agreement to an end without the consent of the organization. However, we ask that you give 3 months' written notice of your intention to end the opt-out.
The organization will maintain records of those employees who have agreed to opt-out.
If after reading the information above you agree to opt-out of the 48-hour working rule please read and sign the Consent section of this document below.

Employee's Individual Consent to Opt-Out of the 48-Hour Rule

I HEREBY AGREE:

That Regulation 4(1) of the Working Time Regulations 1988 will not be applied in relation to my working hours.
To work in excess of 48 hours per week on average if reasonably required by the organization under the terms of my employment.
